If your concrete driveway connects to a NYC city street — which it almost certainly does — you legally need a DOB permit to replace it. Skip this step and the city can issue a violation, force you to tear out the new pour, and refuse to issue a CO for any future renovation. We file every permit as part of the job.
DOB vs DOT — who regulates what
NYC Department of Buildings (DOB)
Regulates everything on your private property: the slab, the base, the reinforcement, the pitch. Issues the actual concrete driveway permit ($75–$250 depending on filing class).
NYC Department of Transportation (DOT)
Regulates the curb cut — the section of the curb that's been lowered to let your driveway meet the street. Required separately if you're cutting a new curb (not replacing an existing one). Existing curb cuts grandfathered if the original was DOT-approved.
Short version: 95% of replacement jobs need only the DOB permit. New driveway = DOB + DOT.

Borough-specific NYC permit notes
Brooklyn
Brooklyn DOB office (210 Joralemon St) processes permits in 5–10 business days. Rowhouse driveways in Bay Ridge, Dyker Heights and Canarsie are routine. Shared driveways need both owners' signatures on the PW-1.
Queens
Queens DOB (120-55 Queens Blvd) — largest filing volume in the city. 7–14 day turnaround. Flushing and Astoria conversions often trigger additional zoning review.
Staten Island
Fastest borough for permits — 3–7 business days at the Richmond DOB office. Suburban lots rarely trigger zoning issues. New construction driveways usually need a DOT curb cut alongside the DOB permit.
Bronx
Bronx DOB (1932 Arthur Ave) — 5–10 days standard. Riverdale and Pelham Bay are the strongest detached-home zones; Co-op City driveways need HOA sign-off in addition to DOB.
Manhattan
Manhattan DOB (280 Broadway) processes the most complex applications. Carriage-house and townhouse driveway permits often require a DOT lane-closure permit on top of the DOB filing. 10–21 day total turnaround.
What happens if you skip the NYC driveway permit
- $1,250+ DOB violation issued on the property record
- Stop Work Order if caught mid-pour
- Forced removal of the new slab at homeowner expense
- Block on any future CO, ALT-1 or ALT-2 filing on the property
- Insurance claims denied if a guest is injured on the unpermitted slab
Cheap contractors skip the permit to undercut on price. The savings ($75–$250) are never worth the violation exposure.
